Acceptable Use Policy
1. About this Acceptable Use Policy
1.1 This Acceptable Use Policy (“AUP”) sets out the rules that apply to use of the TradieView Platform, website, applications, APIs and related services.
1.2 This AUP forms part of the Agreement between Tradie View Pty Ltd (“TradieView”, “we”, “us” or “our”) and the Customer. It applies to the Customer and all Users (including Administrators and holders of Connection accounts).
1.3 This AUP sits within the order of precedence described in the Product Terms and Terms & Conditions. Where API Supplementary Terms (if published) impose additional or more specific requirements for API use, those requirements apply in addition to, and do not limit, this AUP.
1.4 Capitalised terms not defined in this AUP have the meaning given in the Terms & Conditions or Privacy Policy.
2. Permitted Use
2.1 The Platform may be used only for lawful business purposes in accordance with the Agreement and applicable law.
2.2 The Customer is responsible for ensuring that all Users comply with this AUP.
3. Prohibited Conduct
3.1 You must not, and must not permit any User to:
- use the Platform for any unlawful, fraudulent, harmful or abusive purpose;
- upload, transmit or store any content that is illegal, defamatory, obscene, harassing, hateful, or that infringes the intellectual property, privacy or other rights of any person;
- upload malware, viruses, ransomware or any other malicious code;
- attempt to gain unauthorised access to the Platform, other accounts, systems or networks;
- interfere with, disrupt or degrade the Platform or the experience of other customers;
- reverse engineer, decompile, disassemble, scrape, crawl or systematically extract the Platform’s software, source code, templates, workflows, non-public documentation or non-public business rules;
- use non-public information obtained through your access to the Platform (such as pricing structures, product roadmaps or confidential business rules disclosed to you as part of your use of the Platform) to build, market or operate a competing product;
- systematically extract, scrape or reproduce the Platform’s software, templates, workflows or non-public documentation for the purpose of building a substitute product;
- share login credentials or allow unauthorised persons to access the Platform;
- use the Platform to send unsolicited bulk communications (spam) or to engage in any practice prohibited by the Spam Act 2003 (Cth) or equivalent laws;
- use the Platform in violation of applicable trade sanctions or export control laws, consistent with the Product Terms;
- use the Platform in any way that creates a security, privacy, legal, operational or reputational risk to TradieView, its customers or third parties; or
- attempt to circumvent any usage limits, security controls or technical restrictions.
3.2 AI-specific prohibited conduct. When using AI-powered features you must not:
- use AI features to generate content that would itself breach Section 3.1 (for example, illegal, defamatory or infringing content);
- attempt to bypass, manipulate or extract the underlying instructions, safety controls or non-public configuration of any AI model integrated with the Platform; or
- represent AI-generated output (such as an extracted invoice figure, a drafted communication, a summary or a recommendation) to a third party as independently verified or professionally reviewed advice without first reviewing it yourself.
4. Customer Data and Content
4.1 The Customer is solely responsible for all Customer Data and content uploaded, created or transmitted through the Platform.
4.2 The Customer must ensure it has all necessary rights, notices, permissions and lawful bases to upload and process Customer Data (including personal information about employees, contractors, clients and suppliers).
5. Communications and Messaging
5.1 The Customer must comply with all applicable laws governing electronic communications, including the Spam Act 2003 (Cth), the Privacy Act 1988 (Cth) and any equivalent state or territory legislation.
5.2 TradieView may suspend or restrict messaging features (email, SMS or other) where it reasonably suspects spam, abuse or breach of law.
6. API Use
6.1 Use of any TradieView API is subject to this AUP and any applicable API Supplementary Terms published at https://tradieview.com/legal/api-terms (or such other location as TradieView may notify).
6.2 API access may be rate-limited, suspended or revoked for abuse, excessive use or breach of this AUP.
7. Security
7.1 You must not attempt to probe, scan or test the vulnerability of the Platform or any related system.
7.2 You must promptly notify TradieView of any actual or suspected unauthorised access or security incident at support@tradieview.com.
8. Consequences of Breach
8.1 If you breach this AUP, TradieView may (depending on the circumstances) take one or more of the following actions:
- issue a warning;
- require you to remove or stop the offending activity;
- suspend or restrict access to specific features, Accounts or Connection accounts;
- suspend or terminate the Account;
- remove or disable access to offending content; and/or
- take any other action available under the Terms & Conditions or at law.
8.1A TradieView will exercise the rights in Section 8.1 in a manner proportionate to the nature, severity and repetition of the violation. Other than in the urgent circumstances described in Section 8.3, TradieView will give the Customer a reasonable opportunity to remedy a violation before suspending or terminating an Account for it.
8.2 Suspension or termination for breach does not relieve the Customer of any obligation to pay Fees that are due.
8.3 Where practical, TradieView will give prior notice of suspension. Immediate suspension may occur for urgent security, illegal activity, non-payment, suspected unauthorised access, API abuse, spam, malware, privacy breach or third-party provider requirement.
