Data Processing Addendum
1. Purpose
1.1 This Data Processing Addendum (DPA) describes how Tradie View Pty Ltd handles Customer Data and personal information on behalf of business customers.
1.2 It supplements the Terms & Conditions and Privacy Policy.
2. Roles of the parties
2.1 The Customer determines what Customer Data is entered into TradieView and how it is used. For personal information the Customer is the data controller.
2.2 TradieView processes Customer Data to provide, secure, support, maintain and improve the Platform. For personal information TradieView is a data processor.
2.3 Each party must comply with its own obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
2.4 Where GDPR, UK GDPR or other data protection laws apply to a specific Customer, additional controller/processor terms may be agreed under an SOW.
3. Customer obligations
3.1 The Customer must ensure it has all rights, notices, consents and lawful bases required to provide personal information to TradieView.
3.2 The Customer must not provide sensitive information (APP 3) to TradieView unless permitted by law and necessary for use of the Platform.
3.3 The Customer is responsible for responding to individuals whose personal information is controlled by the Customer, unless TradieView is legally required to respond directly.
4. TradieView obligations
4.1 TradieView will process Customer Data for the purposes of providing, maintaining, securing, supporting and improving TradieView, complying with law, enforcing the Agreement and as otherwise permitted by the Agreement.
4.2 TradieView will take reasonable technical and organisational measures to protect Customer Data (see the Security Statement).
4.3 TradieView will restrict access to Customer Data to personnel and service providers who need access for legitimate purposes.
5. Sub-processors and service providers
5.1 The Customer authorises Tradie View Pty Ltd to use third-party providers for hosting, storage, infrastructure, security, payments, email, SMS, analytics, support, logging, monitoring, identity, AI and integrations. The current list is maintained in the Sub-Processor and Third-Party Provider List.
5.2 TradieView will take reasonable steps to select reputable providers and ensure appropriate confidentiality and security obligations apply.
5.3 TradieView may update providers from time to time for operational, security, legal or commercial reasons. Material changes will be reflected in the Sub-Processor List.
6. International processing
6.1 Customer Data and personal information may be processed or accessed outside Australia by providers or sub-processors.
6.2 TradieView will take reasonable steps required by APP 8 of the Privacy Act before disclosing personal information to overseas recipients.
7. Security incidents and data breaches
7.1 TradieView will assess suspected incidents affecting Customer Data and comply with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act.
7.2 TradieView will notify the Customer at support@tradieview.com contact without undue delay where an incident materially affects Customer Data or where notification is required by law.
7.3 The parties will cooperate in good faith in relation to containment, assessment, notification, remediation and regulatory response.
8. Data export, return and deletion
8.1 During the subscription term, the Customer may export available Customer Data using platform export tools where available.
8.2 After termination, the Customer may request export for a period of 30 days.
8.3 After the export period, TradieView may delete, de-identify or archive Customer Data in accordance with retention practices.
8.4 Backup copies may remain until overwritten or deleted in the ordinary backup cycle.
9. Audits and information requests
9.1 TradieView may provide reasonable information about security and data handling to enterprise customers upon request to support@tradieview.com.
9.2 Audits, questionnaires, security reviews or due diligence outside standard support may be subject to fees, confidentiality obligations and reasonable scheduling.
10. Survival
10.1 This Addendum survives termination to the extent required to complete export, deletion, legal retention, audit, dispute or breach response obligations.
